Family law mediation: What is it?

In Florida, every family law case must go to mediation before a trial court decides the merits. The exception is cases involving domestic violence injunctions. If there is a family law case and a domestic violence case involving the same parties, a judge must issue an order allowing the mediation.

Mediation is when the parties and their lawyers met with a mediator and try to come to an agreement. This can either be done with both parties in the same room or separately. The goal is to resolve the issues in the case.

At mediation, all of the issues can be resolved, some of the issues can be resolved, or none of the issues can be resolved. Any remaining issues will be sent to the judge to conduct a trial. Of course, the parties can always settle amongst themselves at any time up until trial.

There are two types of mediation, private and through court services. In private mediation, the parties get to choose their mediator. The lawyers can suggest mediators who they have a track record with. Private mediation is usually more expensive, but I have found that more of my cases settle with private mediators.

Mediation through court services is when the parties show up at the courthouse and get whatever mediator is available. There is a cap on the pcombined income when using court services mediation. That cap is $100,000.00. If the parties make a combined income of $50,000.00 to $100,000.00, the mediation fee is $120.00 per hour, under $50,000.00, the fee is $60.00 per hour. Court mediation is so busy they will seldom go more than an hour. Private mediation will go on as long as needed. Parties with a combined income of over $100,000.00 must go to private mediation.

Most of my clients report feeling as though they got a better result in mediation as opposed to a trial. Studies support this assertion. I always believe the people involved in the case are more knowledgeable about their lives than a judge who interacts with their case for only a short period of time.
