It is true! In Florida, you do not have to be driving to get arrested for DUI. Florida law allows for the prosecution of driving under the influence if you are in actual physical control of a vehicle. I have seen people arrested while sleeping in their car, while next to their car, and while sleeping in the back seat of their car. All of these people had the car keys in their pocket, in their hand, or on their person. The bottom line is, get rid of your car keys before you pass out in your car.
I explain complex legal terms and concepts in ordinary language. I present Domestic violence concepts, family law terms, and criminal defense tips to help you navigate the Florida legal system.
